Terms of Service

Acuarela generates photorealistic on-model color variants from your product photos, lets you review them, and can publish approved images to your Shopify or WooCommerce store. Features depend on your plan and your remaining image allowance.

Acuarela is for businesses. You confirm that you use it for your business and that you have authority to bind it to these Terms.

• Shopify app: you must have a Shopify store and authority to install apps and grant the requested permissions.
• Acuarela Studio: you need an invite to create an account. Keep access to your sign-in email or Google account secure; you are responsible for activity on your account.
• WooCommerce: you must have authority to create API keys for the store you connect.

You keep your rights in the photos and product content you provide. You give us a limited license to host, process, and transmit that content only to operate Acuarela, including AI image generation. You confirm that you have the rights and permissions this requires, including consent from any identifiable person pictured.

Generated images come from automated models and can contain artifacts or unexpected results. Review every image before publishing it. You may use approved images commercially on your store, subject to these Terms and the terms of our model providers. We do not guarantee that a generated image will match a reference exactly or be free of defects.

• No unlawful, infringing, or deceptive content
• No attempts to reverse engineer the service, get around limits, or access other customers’ data
• No uploading personal information you are not authorized to process
• No reselling the service without a written agreement

Plans include a monthly image allowance, described in the app. Usage is counted when generations run, including retries.

• Shopify app: charges go through Shopify Billing and appear on your Shopify invoice. Change your plan in the app or cancel by uninstalling; Shopify’s billing policies also apply.
• Acuarela Studio: subscriptions are billed monthly in advance, in US dollars, through Stripe, plus applicable taxes. They renew automatically each month until you cancel. Cancel any time under Manage subscription; cancellation takes effect at the end of the period you have paid for, and you keep your plan until then.
• Acuarela Studio: unused plan images carry over for one month. Image top-ups are one-time purchases, valid for 12 months.

Fees are non-refundable except where the law or Shopify’s billing policies require otherwise. We will give you at least 30 days’ notice, in the app or by email, before a price change applies to your subscription; you can cancel before it does.

Your use of Shopify, WooCommerce, Stripe, and Google is governed by their own terms. We are not responsible for those services.

We aim for continuous availability but do not guarantee uninterrupted service. Support is available at go@adwaizer.com; see our Support page for response times.

To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Adwaizer AI Consulting Inc. and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for claims relating to the service will not exceed the amounts you paid us for the service in the three months before the claim, or CAD $100 if that is greater or no fees were paid.

You can stop at any time: uninstall the app, disconnect WooCommerce, or ask go@adwaizer.com to close your Studio account. We may suspend or end access for a breach of these Terms or a risk to the service. Provisions that by their nature should survive, including intellectual property, disclaimers, and limits of liability, survive termination.

We may update these Terms. The date above will change, and we will tell you about material changes in the app or by email before they apply.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts of Ontario have exclusive jurisdiction, except where the law of your province or territory provides otherwise.

These Terms are available in English and French, and both versions have equal force.
