Terms of Service

Acuarela helps merchants generate photorealistic on-model colorway images from model poses and ghost (color reference) photos, review results, and optionally push approved images to Shopify product media. Features depend on your plan and available image allowance.

You must have a Shopify store and authority to install apps and grant the requested Admin API scopes. You are responsible for your store’s compliance with Shopify’s terms and applicable law. Billing for paid plans is charged through Shopify Billing and appears on your Shopify invoice.

You retain rights in photos and product content you provide. You grant us a limited license to host, process, and transmit that content solely to operate Acuarela (including AI image generation). You represent that you have the rights to use uploaded images (including model and product photography) for this purpose.

Generated images are produced by automated models and may contain artifacts or unexpected results. You should review every output before publishing. Outputs are provided “as is” for your commercial use on your storefront, subject to these Terms and third-party model provider terms. We do not guarantee that any generation will match a reference perfectly or be free of defects.

• No unlawful, infringing, or deceptive content
• No attempts to reverse engineer, abuse rate limits, or probe other shops’ data
• No uploading of personal data you are not authorized to process
• No resale of the service as a white-label without a written agreement

Free and paid plans include monthly image allowances as described in the app. Usage is debited when generations run (including retries). Fees are non-refundable except where required by law or Shopify’s billing policies. We may change plans with notice via the app or email.

We aim for continuous availability but do not guarantee uninterrupted service. Support is available at go@adwaizer.com; see our Support page for response expectations.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Adwaizer AI Consulting Inc. AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM (OR CAD $100 IF GREATER AND NO FEES WERE PAID).

You may uninstall the app at any time. We may suspend or terminate access for breach of these Terms or risk to the service. Provisions that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Ontario have exclusive jurisdiction, except where prohibited.
